Can sales tax that has been discharged in a Chapter 7 Bankruptcy have a lien applied to the debtor post discharge? The tax was for sales tax on a motor vehicle. The creditor, being Georgia Dept of Revenue are listed in the list of creditors for the Chapter 7 and on the list of debts that the US Trustee discharged. Prior to filing the Chapter 7 and prior to the discharge by the US Trustee there was no lien for this debt. I understand that in most cases that the lien would survive a Chapter 7 discharge if it existed prior to the discharge, but lien has been filed almost three years post discharge and seven years since it was acquired.
